TERMS OF SERVICE

Included in this agreement is the Scope of the Agreement; The Terms and Cost; and Agreement. This Agreement is a part of the Consumer Engagement Company (Thece) service program. Thece product purchases can be made 

The Service provides customization of the customer’s Mobile Experiences and QR Billboards to match the brand. To achieve this effect Thece will conduct design work on all elements (fonts, colors, images, cover cards, language) to fit within the brand narrative. Thece provides: 1) support on question development, 2) graphic design services, and 3) strategies on distribution to audience.

Scope and Deliverables

The following items are included in the Service Agreement:

  • Consultation — Engagement Strategy (Questions, Statements, Activation, Experience)
  • Project Management — Remote team to ensure successful set-up and first delivery
  • Construction of 1 theme — (Theme = Background + Fonts + Question Card Design + Call to Action Style + Real-time Billboard Design)
  • Mobile Consumer Experience (CE) based on theme — (Mobile Experience = Cover cards + Content Cards + Question Insertion + Call To Action Links)
  • System Training — How to use the Thece platform (Clone, edit, publish, Billboard, QR, etc)
  • Data — All response Data + Leads + Conversion Metrics + Facebook Pixel Integration (optional)
  • Initial Response Wallet — 5,000 Responses included with program.

Terms & Cost

The cost of the engagement is $2,500 US dollars. Discounts are available from sales through certain channel partners. Any additional services not mentioned will be quoted and due upon conclusion of such services. Additional themes  and CEs are $500 each. The service program comes with 5,000 responses in your wallet. Additional responses can be purchased on the platform on a sliding scale and can be found at http://www.thece.co/pricing. 

Privacy and Terms of Use

The Product Terms of Use can be found at: http://www.thece.co/terms. The Consumer Engagement Company cares deeply about privacy. The default position is anonymity. Our policy can be found at http://www.thece.co/privacy . 

Agreement

The Consumer Engagement Company (Company) will be in constant communication with (Client) and adjust the plan as needs are identified.  Client is expected to communicate any questions or expectations to the Company to allow for timely adjustment. 

LATE FEES:  Fees and costs billed and not paid within 30 days will accrue a service charge of the lesser of 1% per month or the highest rate permitted by law at the time the bill becomes overdue.  If there is a dispute regarding an invoice, the dispute must be addressed within 60 days of the date of the invoice or the invoice will be considered correct.

DISCHARGE OF COMPANY: Client may, at any time, discharge Company for any reason or no reason by written notice, which will become effective upon receipt by Company. Upon receipt, Company will cease providing any services to Client, unless otherwise agreed upon. Fees paid and/or earned are non-refundable.

PROMOTIONAL USE: Company retains the right to use the completed work in any form for promotional purposes.

WITHDRAWAL OF COMPANY: Company may end Client representation at any time for any reason or no reason by written notice. In this event, any fees for services paid not earned will be refunded or credited against other fees and expenses that remain owed by Client to Company.

SEVERABILITY: If any provision of this Agreement shall be held to be invalid or unenforceable for any reason, the remaining provisions shall continue to be valid and enforceable. If a court finds that any provision of this Agreement is invalid or unenforceable, but that by limiting such provision it would become valid and enforceable, then such provision is to be deemed to be written, construed, and enforced as so limited.

MODIFICATIONS: This Agreement may be modified only by the execution of a written agreement signed by Company and Client. If Client desires any additional services that have not been included in this Agreement by letter or intent, a separate agreement will be executed.

APPLICABLE LAW: The laws of the State of Washington govern this Agreement.

ARBITRATION OF DISPUTES BETWEEN CLIENT AND COMPANY: If there is any dispute between Client and Company, such dispute will be resolved by binding arbitration.   

EFFECTIVE DATE AND SIGNING OF THIS AGREEMENT: This Agreement will become effective when purchase is made by Client. This date sets the time stamp for the one-year use of the product and must be renewed to continue product usage.
